Heiz-Hemmer Maintains Industrial Design Registration for Its Iconic Mustard and Ketchup Packaging Lines

In an important decision for the field of intellectual property, Heinz-Hemmer, represented by Ritter Advogados, emerged victorious in the legal dispute over the ownership of the Industrial Design (INPI | BR 30 2016 002598) for the bottles of its famous mustard and ketchup lines.
The judgment, handed down by the 1st Federal Court of Blumenau/SC, denied the request made by Eco Brasil Indústria e Representação Comercial Eireli, which sought the annulment of the Industrial Design registration or its adjudication in favor of the company.
Eco Brasil claimed to have directly participated in the creation process for the packaging bottle design, arguing that the registration filed by Heinz-Hemmer with the National Institute of Industrial Property (INPI) was improper. However, Federal Judge Leandro Paulo Cypriani concluded that the design development took place within the scope of the contractual relationship established between the parties, with creative responsibility and ownership rights legitimately belonging to Heinz-Hemmer, as authorized by Articles 88 and 121 of the LPI (Industrial Property Law – Law No. 9,279/96).
