INPI Reports an Increase in Computer Program Registrations

According to the INPI, “for the first time since the implementation of the e-Software system in September 2017, filings for computer program registrations with the INPI reached a monthly record, with 366 applications submitted in May 2021. This figure may be attributed to the Institute’s efforts to expand the dissemination of intellectual property in Brazil and to encourage innovation and business competitiveness.”¹

According to data from a study conducted by the Brazilian Association of Software Companies (ABES), the sector grew by 10.5% in 2019, generating approximately US$ 44.3 billion in revenue, considering the software, services, hardware, and industry export markets.

The same study also reported that “the global Software and Services market reached US$ 1.332 trillion in 2019, while Brazil fell to 11th place in the global ranking, with a domestic market of approximately US$ 20.5 billion.”.”².

Despite Brazil’s drop in the global ranking, the good news reported by the INPI is that there was a 20% increase in the number of computer program filings, demonstrating greater concern among users of the system with obtaining stronger legal certainty. Although software registration is optional, it significantly facilitates proof of ownership and authorship.

Currently, computer program registration is carried out through the INPI’s e-Software system. The applicant simply needs to encrypt the source code, converting it into a digital hash summary, which will be requested by the INPI at the time of filing.

Considering the size of the market and the amounts it generates, the proper protection of this intangible asset is essential and should increasingly become a priority for developers and companies.
