INPI Implements Priority Trademark Processing Starting in August 2025

Starting August 7, 2025, the Brazilian National Institute of Industrial Property (INPI) will roll out its new Priority Trademark Processing service, designed to accelerate the examination of trademark applications and related petitions. Part of the INPI 2025 Action Plan, this measure aims to strengthen the innovation ecosystem and foster sustainable economic growth across the country.

The new procedure will allow qualifying trademark applications to receive expedited processing, whether by statutory entitlement or due to strategic relevance to public policies.

Requests may be submitted by the applicant or an appointed legal representative, requiring the completion of the designated form, submission of supporting documentation, and, where applicable, payment of the specific fee. For co-owned applications, all joint applicants must satisfy the eligibility criteria.

The INPI established two distinct modalities for requesting priority processing:

1. Statutory Priority (free of charge, no quota limits):

Exempt from fee payments, the following applicants may request priority processing:

Individuals aged 60 or older;

Persons with disabilities;

Individuals suffering from serious illnesses;

Companies enrolled under the Inova Simples regime.

2. Strategic Priority (fee-based, subject to quota limits):

For the scenarios below, an official fee of R$ 890.00 will apply, subject to quota availability:

Trademark owners who filed an opposition based on prior rights (direito de precedência);

Applicants requiring trademark registration to release public funds;

Parties involved in a lawsuit related to the trademark;

Applications tied to products or services covered by patents subject to priority examination;

Scientific, Technological, and Innovation Institutions (ICTs);

Participants in INPI mentorship programs established under a Technical Cooperation Agreement (ACT);

Cases of public interest or national emergency.

The implementation of Priority Trademark Processing represents a major milestone for the Brazilian trademark system, bringing greater speed and predictability to procedures and catering directly to those with urgent or strategic needs.
